Congratulations for investing in our Security Plan for your Heating/Air Conditioning system. This plan includes 100% labor and 100% parts coverage for the equipment listed as indicated on the front of this agreement. Arctic Heating & Cooling LLC uses the utmost care in the installation of its products. The Heating and/or Cooling system is warranted to be free from defects in materials and workmanship, subject to the limitations, qualifications, and conditions below.

TERMS AND CONDITIONS

WHAT IS COVERED:

This guarantee covers the Heating and/or Cooling System.

STATEMENT OF EXTENT OF GUARANTEE:

Subject to the limitations and exclusions set forth below, in the event of a malfunction or failure of the product as a result of a defect in material or workmanship. Arctic Heating & Cooling LLC, at its election, will replace or repair the product including the cost of parts and labor. Malfunctions, failure or damage to the product not caused by a defect in material or workmanship are specifically excluded from this guarantee. In the event any repair is performed on or additions are made to this product during the terms of this guarantee by anyone other than an authorized representative of Arctic Heating & Cooling LLC, at its election Arctic Heating & Cooling LLC can void this guarantee. This guarantee shall not apply to expendable parts, nor to the finish of any painted product. This guarantee does not include any claims or damages for incidental or consequential damages.

ADDITIONAL GUARANTEES:

There are no guarantees expressed or implied not specifically contained herein except an implied guarantee for fitness for the purpose intended. Any and all implied warranties imposed by State law, if any shall be limited to the terms of the express guarantee herein concluded.

TERMS OF GUARANTEE:

This guarantee shall extend for a period stated from the date of original installation by the first consumer purchaser, and may be transferred to a new owner on written notification to our office. Service is provided Monday thru Friday, 8:00 AM to 4:30 PM, 24 Hour Emergency Service is available at prevailing rates.

PROCEDURE TO BE TAKEN TO OBTAIN PERFORMANCE OF GUARANTEE:

To obtain performance of this guarantee obligation, the eligible consumer should contact Arctic Heating & Cooling LLC at (609) 758-2237

REFUND IN LIEU OR REPAIR OR REPLACEMENT:

In the event Arctic Heating & Cooling LLC is unable to repair or replace the product or a necessary part because the product or part is no longer manufactured or is otherwise commercially unavailable or because a change in laws or regulations regarding system efficiencies or refrigerants renders repair or replacement unlawful, the guarantor will, in lieu of repair or replacement of the product, make a refund of the initial cost of the product, less and amount equal to the straight line depreciation of the product based on a useful life of 10 years. Such refund must be applied toward the purchase of a new Arctic Heating & Cooling LLC system.

EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES:

This guarantee applies only to repair or replacement of the product and does not afford any coverage with respect to incidental or consequential damages, nor shall any claim be greater in amount than the purchase price of the product to which such claim is made.

OTHER EXCLUSIONS:

This guarantee does not afford any coverage with respect to repairs or replacement required as a result of the failure of the consumer to provide necessary maintenance, an act of God, circuit breakers, lighting pilots or blown fuses. This guarantee requires the owner to properly maintain the equipment seasonally through the purchase of Arctic Energy Savings Maintenance Agreement for the life of the guarantee.

If Arctic Heating & Cooling LLC fails to satisfy you under the terms of our agreement during the first year, beginning with the day of completion of installation, Arctic Heating & Cooling LLC will remove the system and refund your entire investment.
